Our Terms

This page tells you information about us and the legal terms and conditions (Terms) on which we sell any of the Goods (Goods) listed on our website (our site) to you.

1. These terms

1.1 These Terms will apply to any contract between us for the sale of Goods to you (Contract).

1.2 Please read these Terms carefully and make sure that you understand them, before ordering any Goods from our site. These terms tell you who we are, how we will provide Goods to you, how you or we may change or end the Contract and what to do if there is a problem and other important information. Every time you wish to order Goods, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated in April 2017.

1.3 These Terms, and any Contract between us, are only in the English language.

2. General 

2.1 Our contract with customers is covered by the Consumer Rights Act 2015 (the Act) and The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. 

2.2 Please be aware that new bikes need a period of bedding in & may be subject to rattles, squeaks and creaks. This is quite normal & the drivetrain, in particular, is likely to need adjustment to continue to operate satisfactorily. In addition to regular maintenance, bikes should be regularly checked by a professional for safety.

2.3 None of our terms affect your statutory rights. In addition to your statutory rights, our products may be subject to various manufacturers’ warranties and guarantees. We will assist you in taking advantage of these warranties and guarantees provided the goods are returned to us within the relevant period. We do not pay for the costs involved in returning or redelivery.

3. Information about us and how to contact us 

3.1  Cyclop Bikes operates the website www.cyclopbikes.co.uk.

4. Our contract with you

4.1 Our acceptance of your order will take place when you click and submit the order to us. At this point, a contract will come into existence between you and us.

4.2 If we cannot accept your order we will inform you of this and will not charge you for the Goods. This might be because the Goods are out of stock, because of unexpected limits on our resources which we could not reasonably plan for because we have identified an error in the price or description of the Goods.

5. Our Goods

5.1 Goods may vary slightly from their pictures. The images of the Goods on our website are for illustrative purposes only. Although we make every effort to display the colours accurately, we cannot guarantee that a device's display of the colours or the printed pictures accurately reflects the colour of the Goods. Your Goods may vary slightly from those images.

6. Providing the goods (delivery)

6.1  The costs of delivery will be as displayed to you on our website when you order Goods and checkout. 

6.2 We will contact you with an estimated delivery date and courier's track & trace number. Goods will be delivered to you by courier and it takes:

Dutch Bikes:
- 5-6 days to England
- 6-7 days to Scotland and Wales
- 8-11 days Northern Ireland

Danish Cargo Bikes: 7-10 working days 

Accessories: 5-7 working days. 

Essentials: shipped directly from China, therefore, it may take up to 45 days. 

6.3 When the bike delivery arrives, ensure that this is the right bike with the correct specification before accepting delivery. In the unlikely event that the bike is different from what was ordered,  refuse the delivery and tell the shipper to send it back to the sender. We will then ensure that the correct bike is sent as soon as possible. 

6.4 Bike deliveries: please check if the boxes are original with the brand branding [Popal, Amladcykler, Vogue] and note on the shipping papers if there are any damages to the boxes. If boxes do not appear to be original/branded, please take photographs and forward to hello@cyclopbikes.co.uk 

6.5  We are not responsible for delays outside our control. If our supply of the Goods is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.

7. Exercising your right to change your mind/cancel  (Consumer Contracts Regulations 2013).

7.1 Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel distance and off-premises contracts within 14 days without giving a reason.

7.2 The cancellation period will expire 14 days from the date on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

7.3 To exercise the right to cancel, you must inform us, Cyclop Bikes, of your decision to cancel the contract by a clear statement preferably via email (hello@cyclopbikes.co.uk).

7.4 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired. We recommend that you send this by email.

8. Effects of cancellation

8.1 If you cancel this contract, we will reimburse to you all payments received from you, except the costs of delivery. Costs of delivery are as follows:

- Dutch bikes £50 

- Danish bikes £150 

- Accessories £20 

8.2 We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you.

8.3 We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied.

8.4 You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from the contract to us. The deadline is met if you send the goods back before the period of 14 days has expired.

8.5 Once you notify us about your intention of exercising your right to return, we will provide you with our return address in Netherlands/Denmark/Poland [as applicable]. You will have to bear the direct cost of returning the goods. 

8.6 We can only accept returns of goods in original condition, undamaged which has not been used (a bike which has been ridden once is considered as used). 

9. Our warranty for the goods

9.1 All our Dutch bikes and electric Dutch bikes batteries come with a one-year standard warranty; Danish bikes come with 2 years warranty on non-moving elements and 6 months warranty on batteries. 

9.2  We provide a warranty that on delivery the Goods shall be free from material defects. However, this warranty does not apply in the circumstances described in clause 9.3

9.3 The warranty in clause 9.1 does not apply to any defect in the Goods arising from:
(a) fair wear and tear;
(b)  light corrosion and the tires;
(c) wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;
(d) if you fail to operate or use the Goods in accordance with the user instructions;
(e) any alteration or repair by you or by a third party who is not one of our authorised repairers; or
(f) any specification provided by you.

10. Our right to cancel and applicable refund

10.1 Cyclop Bikes may have to cancel an Order before the Goods are delivered, due to an Event Outside Cyclop Bike's Control or the unavailability of stock. If this happens:
(a) we will promptly contact you to let you know.
(b) we will offer your full refund and/or alternative goods 

11. How we may use your personal information

11.1 We will use the personal information you provide to us:
(a) to supply the Goods to you;
(b) to process your payment for the Goods and
(c) if you agreed to this during the order process, to inform you about similar products that we provide, but you may stop receiving these at any time by contacting us.

11.2 We will only give your personal information to third parties where the law either requires or allows us to do so or where you have given permission to us to share your information.
